Terms of use

Applicable to users who have or have had an active license to access ReCoRe

1. Acceptance of Terms
By accessing or using the ReCoRe platform ("the Platform"), you ("the User") agree to comply with and be bound by these Terms of Use. These Terms of Use are supplementary to any contractual agreements entered into between the User and CIRCPACK. In the event of a conflict, the terms specified in the contractual agreement shall take precedence.

2. License and Permitted Use
The Platform and its content, including but not limited to datasets, analyses, and any related intellectual property (collectively referred to as "Data"), are provided exclusively for the User’s internal business purposes as outlined in the contractual agreement. Any use of the Platform or Data beyond the scope of this permitted use is expressly prohibited without prior written consent from CIRCPACK.

3. Prohibition on Data Sharing
The User agrees that sharing, distributing, or otherwise disclosing the Data to any third party is strictly prohibited unless explicitly authorized in writing by CIRCPACK. This restriction applies to all forms of sharing, including direct data transfer, visual representations, and derivative works based on the Data.

4. Ownership of Data
All Data provided on the Platform remains the sole property of CIRCPACK. Use of the Data by the User does not grant ownership or any transfer of rights. CIRCPACK retains full legal and intellectual property rights to the Data, even in instances where it has been used to create derivative outputs.

5. Liability for Unauthorized Use
Any unauthorized sharing or use of the Data, including but not limited to dissemination to third parties, will be considered a breach of these Terms of Use. CIRCPACK reserves the right to take all appropriate legal actions, including but not limited to pursuing claims for damages, costs, and injunctive relief, to protect its rights.

6. Data Security and Confidentiality
The User is responsible for implementing and maintaining adequate security measures to prevent unauthorized access, sharing, or misuse of the Data. The User agrees to immediately inform CIRCPACK of any suspected or actual breach of data security.

7. Prohibited Activities
The User agrees not to engage in the following activities:
- Reverse-engineering or decompiling the Platform or its features.
- Using the Data for purposes outside the intended scope of use.
- Removing, altering, or obscuring any proprietary notices or disclaimers on the Data.
- Representing the Data as originating from any source other than CIRCPACK.

8. Termination of Access
CIRCPACK reserves the right to terminate or suspend the User’s access to the Platform without prior notice in the event of a breach of these Terms of Use. Termination does not absolve the User of liability for prior breaches.

9. Indemnification
The User agrees to indemnify and hold CIRCPACK harmless from any claims, damages, or losses resulting from:
- Breach of these Terms of Use.
- Unauthorized sharing or use of the Data.
- Failure to implement adequate data security measures.

10. Disclaimer of Warranties
The Platform and Data are provided "as is" and "as available," without warranty of any kind, express or implied. CIRCPACK does not warrant that the Data is error-free, complete, or fit for any particular purpose.

11. Limitation of Liability
To the fullest extent permitted by law, CIRCPACK shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use the Platform or Data, even if CIRCPACK has been advised of the possibility of such damages.

12. Governing Law and Jurisdiction
These Terms of Use shall be governed by and construed in accordance with the laws specified in the User’s contractual agreement with CIRCPACK. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts specified in the contractual agreement.

13. Amendments
CIRCPACK reserves the right to update or modify these Terms of Use at any time without prior notice. Users will be informed if changes are made. Continued use of the Platform following such changes constitutes acceptance of the revised Terms.
